Terms & Conditions

We take great pride in the services we provide. Delivering a quality workforce to your organization is a responsibility we take very seriously. Please review our policy and standard terms for temporary and temp-to-hire personnel.

The following terms and conditions apply to Masiello Employment Services supplying temporary personnel to client companies and organizations. The signature of the Client’s agent on the face of timeslip or the approval received via facsimile or electronically of hours constitutes full acceptance of the following terms and conditions. To the extent that this contract conflicts with any other signed written agreement between the Client and Masiello Employment Services, the conflicting agreement shall apply.

All hours worked by the temporary employee as a temporary employee will be for services performed on the Client's premises, unless otherwise directed by Client.

All assignments made pursuant to this agreement are made with the understanding that Masiello Employment assumes responsibility for our employee’s weekly check, as well as all related payroll taxes and Workers Compensation insurance. Our employee is required to submit a weekly timeslip for Client approval prior to issuing their check. Client’s approval authorizes us to bill the Client for the hours paid to our employee. Unless other arrangements are made in advance, it is our employee’s responsibility for turning in their approved timeslip to our office. After payment has been made to our employee, the Client will be billed weekly for our employee’s time. Remittance of our invoice is due fifteen (15) days from the billing date.

Our employee cannot be hired prior to a predetermined number of contractual hours, unless arrangements have been made in advance, or a fee will be attached. The client also agrees not to employ the person named for a period of 180 days following the completion of any work assignment without first consulting Masiello Employment to establish the manner in which Masiello Employment will be compensated.

The Client shall not give Masiello Employment’s employee access to, or otherwise entrust Masiello Employment’s employee with unattended premises, cash and other valuables or authorize such employee to operate its machinery or vehicles, without prior written permission for each instance. Masiello Employment Services insurance does not cover loss or damage caused by Masiello Employment’s employee operating Client owned or leased motor vehicle (s) and Client accepts full responsibility for claims, including the defense thereof, involving bodily injury, property damage, fire, theft, collision, cargo, damage or public liability damage sustained or incurred as a result of Masiello Employment’ s employee driving such vehicle(s), or existing out of, or involving, a violation by Client of this provision. It is agreed that Masiello Employment’s employees have no signing authority on behalf of Client. Notwithstanding the foregoing, Masiello Employment Services shall not be liable for any documents signed by a Masiello Employment’s employee, which binds or otherwise obligates Client.

Client further agrees that Masiello Employment Services is entitled to reasonable collection fees, attorney fees, and any other expenses incurred in collection of all charges on Client accounts. It is agreed that neither Masiello Employment Services nor Masiello Employment Services' employee will be responsible for physical loss or damage to, or loss of use of, machinery, equipment, materials or other property while in the care, custody or control of a Masiello Employment’s employee.
